What is the lawsuit threshold's limitation?

- significant disfigurement or scarring
- displaced fractures
- permanent injury (other than scarring or disfigurement)
On the other hand, the verbal threshold does not apply if a person was injured in a car accident involving a commercial vehicle or a vehicle that is not classed as an “automobile” and hence is not obliged to carry PIP coverage (personal injury protection).
A vehicle is defined in N.J.S.A 39-6A-2(a) as:
A “vehicle” is a private passenger automobile of the private passenger or station wagon type that is not used as a public or livery transport for passengers or hired to others with a driver; Other than farming or ranching, a pickup truck, a delivery car, a van, a panel commercial truck, or a camper type vehicle used for leisure purposes owned by a person or by husband and wife who reside in the same home, not commonly used in the insured’s occupation, profession, or corporation…”
